Dr. Olivia NEMETHOVA: EXPLOITING INVENTIONS
The
talk shall provide some considerations on how to assess whether an idea is an
invention, what to do with an invention, possibilities of protecting an
invention by intellectual property rights and possibilities of exploiting the
protection. Accordingly, the talk shall
start with understanding the term “invention” in the sense of the intellectual
property right including examples from practice. Moreover, basis for deciding whether or not to
seek protection for the invention as well as the possible kinds of protection,
their advantages and disadvantages will be discussed. The grant procedure will be briefly
summarized with focus on the European practice.
Finally, an overview will be given regarding litigation and revocation
procedures, including some recent examples.
